1. Definition

This contract does apply to every contract entered into between Karine’s Jewellery. (“The Company”) and each of its customers. All orders are considered as contracts. 

Buyer: the person, firm or company who purchases the Goods from Karine’s Jewellery.

Goods: any goods agreed in the Contract to be supplied to the Buyer by Karine’s Jewellery.

2. Quotations and Prices

Karine’s Jewellery shall endeavour to hold prices, packaging and specifications, however, it shall reserve the right to alter prices, packaging and specifications without prior notice.

Karine’s Jewellery shall invoice all orders at the price effective at the date of dispatch.

Recommended retail price (“RRP”) are for guidance only and are in no way binding upon Karine’s Jewellery.

3. Payment

All orders are pro-forma.

4. Orders/Delivery

Minimum order level of £100 exc. VAT applies.

While Karine’s Jewellery makes every effort to affect delivery within three to ten working days, no guarantee is to be implied as to delivery dates. Karine’s Jewellery shall not be liable for any direct, indirect or consequential loss, costs, damages, charges or expenses caused directly or indirectly by any delay in the delivery of the Goods.

The Goods are at risk of the Buyer from the time of delivery.

Carriage will be charged on all orders by the conveyance of Karine’s Jewellery's choice and at the current rate.

Any change to delivery address details should be confirmed to Karine’s Jewellery as soon as possible.

5. Intellectual Property

The Buyer shall store the goods in such a way that they can be readily identified as being Karine’s Jewellery's property. No right or permission is granted to brand or package under any other trademark.

The offering for sale and selling of Goods by the Buyer shall give the buyer no rights in or to Karine’s Jewellery’s intellectual property and the Buyer is not authorised to register any company names, trade marks or domain names that contain words identical or similar to Karine’s Jewellery’s trade mark.

6. Limitations on Sales of Goods

The Buyer is prohibited from offering for sale or selling the Goods on Internet auction sites.

7. Tolerance

Any illustration or description of size, style weight etc is given in good faith, however cannot be guaranteed as absolutely correct.

All goods are sold to manufacturing tolerances customarily accepted in the trade.

8. Returns/Claims

Karine’s Jewellery is unable to offer sale or return arrangements.

  • Claims for shortages, damages or incorrect goods in delivery must be notified within seven days.
  • Items delivered broken or faulty must be returned to us within fourteen days accompanied by full details of the order date and invoice number
  • Items will only be replaced or credited provided it is clear that there is a manufacturing fault or damage occurs prior to delivery.

Items which have been worn will not be replaced or credited unless it is clear that there is a manufacturing fault.

Items returned to Karine’s Jewellery that do not meet any of the above requirements will be returned to the customer and a handling fee of £5 may be charged.

The issuing of replacements and credit notes is at Karine’s Jewellery’s discretion.

Karine’s Jewellery shall not be liable in respect of consequential loss or damage, nor in respect of conditions or warranties, whether expressed or implied at statute or at common law, which have not been confirmed by it in writing.

Karine’s Jewellery shall not be liable in respect of any kind of complaint against it or non-delivery unless the Buyer notify it thereof in writing within ten days of invoice data and Karine’s Jewellery shall have the option of replacing or crediting the values of the goods in respect of which any kind of claim is made, thereby fully discharging all legal liability in respect thereof.

9. Error

In the unlikely event of Karine’s Jewellery supplying your order incorrectly in any way, Buyer must contact Karine’s Jewellery immediately providing full details of the order date and invoice number. Karine’s Jewellery will endeavour to correct the situation immediately.

10. Contingencies

No liability will be accepted for any failure of, or delay, in performance which is due wholly or partially to restriction by Government or other competent authority strikes, lockouts, failure in Karine’s Jewellery's anticipated supplies of raw materials or to any other cause whatsoever beyond its control.

In the event of any goods (whether ordered as a specific item or as part of a set) proving defective Karine’s Jewellery is prepared to rectify or replace such goods but its liability in respect of or consequent on any such defect, whether in original or replaced goods is limited as aforesaid and does not extend in any circumstances to cover any other expenditure incurred for any consequential damage or loss of profit.

Karine’s Jewellery shall have no liability for loss of profits, loss of business, increased costs or any indirect, consequential or special loss.

11. Export

All clauses as above apply to exported orders. Invoices are pro-forma or on irrevocable letter of credit. All prices quoted are ex-works in pounds sterling.

12. General

No waiver by Karine’s Jewellery of any breach of the contract by the Buyer shall be considered as a waiver of any subsequent breach of the same or any other provisions.

If any provision of the contract is held by a court or other competent authority to be invalid or unenforceable in whole or in part the validity of the other provisions of the contract and the remainder of the provision in question shall not be affected.

The interpretation and performances of these conditions wilt be governed by the law ofEnglandand the parties shall submit to the jurisdiction of the English Courts.
